GENERAL TERMS AND CONDITIONS OF CONTRACTING AND CANCELLATION

This contractual document shall govern the contracting of products and services through the website http://www.lapalmerabcn.com/, owned by DORM & DREAM BARCELONA, S.L., hereinafter referred to as DORM & DREAM BARCELONA, S.L.
Acceptance of this document implies that the USER:– Has read, understands, and comprehends what is stated herein.– Is a person with sufficient capacity to enter into a contract.– Assumes all the obligations set forth herein.
These terms and conditions shall have an indefinite period of validity and shall be applicable to all contracts entered into through the website of DORM & DREAM BARCELONA, S.L.
DORM & DREAM BARCELONA, S.L. informs that the company is responsible for and aware of the applicable legislation of the countries to which it offers its services, and reserves the right to unilaterally modify these terms and conditions, without affecting goods or promotions that were contracted prior to such modification.
Identity of the contracting parties
On the one hand, the provider of the services contracted by the USER is DORM & DREAM BARCELONA, S.L., with registered office at CL JERUSALEM, 30 – 1º, 08001 BARCELONA (Barcelona), VAT number B65761025, and customer service telephone number 618769457.On the other hand, the USER, who registers on the website using a username and password, for which they bear full responsibility for use and safekeeping, and who is responsible for the accuracy of the personal data provided to DORM & DREAM BARCELONA, S.L.
Object of the contract
The purpose of this contract is to regulate the contractual relationship between DORM & DREAM BARCELONA, S.L. and the USER at the moment when the latter accepts, during the online contracting process, the rental of real estate for temporary accommodation.The contractual relationship for accommodation booking entails the rental of the chosen property for a limited period, in exchange for a specified price publicly displayed on the website. Any extra services must be contracted at the time the booking is made.
CONTRACTING PROCEDURE
In order for the USER to access the services or products offered by DORM & DREAM BARCELONA, S.L., they must register through the website by creating a user account. For this purpose, the USER must freely and voluntarily provide the personal data requested, which will be processed in accordance with the provisions of Regulation (EU) 2016/679 of April 27 (GDPR) and Organic Law 3/2018 of December 5 (LOPDGDD), as detailed in the Legal Notice and Privacy Policy of this website.The USER shall select a username and password, committing to use them diligently and not to make them available to third parties, as well as to notify DORM & DREAM BARCELONA, S.L. of their loss or theft or possible access by an unauthorized third party, so that the immediate blocking of the account can be carried out.Once the user account has been created, the USER is informed that, in accordance with Article 27 of Law 34/2002, on Information Society Services and Electronic Commerce (LSSICE), the contracting procedure shall follow the following steps:

GENERAL CONTRACTING CLAUSES
Unless otherwise stipulated in writing, placing an order with DORM & DREAM BARCELONA, S.L. implies the USER’s acceptance of these legal conditions. No stipulation made by the USER may differ from those of DORM & DREAM BARCELONA, S.L. unless expressly agreed to in advance and in writing by DORM & DREAM BARCELONA, S.L.
2. BOOKING PROCESS AND PAYMENT
Our automatic availability and price calculation system will allow you to choose the type of room that interests you and make the reservation of your choice through online payment of an amount corresponding to 50% of your stay.
Dorm & Dream Barcelona S.L. will send an email to the address provided by the USER.
Booking confirmation: Once the corresponding payment has been made, the reservation will be instantly confirmed, and you will immediately receive an email with all the details (address of the establishment, contact person’s information, dates, etc.).
Online payment security: DORM & DREAM BARCELONA, S.L. undertakes to protect USERS’ data to the maximum extent. The company has no access to, nor can it see at any time, the credit card number you enter in the form. This information is encrypted and visible only to the banking institution.
Check-in and Check-out
Check-ins and check-outs at our accommodations are carried out daily.
Check-in: Guest check-in time is from 3:00 p.m. to 8:00 a.m. the following day at our establishment located at C/ JERUSALEM, 30 – 1º, 08001 BARCELONA (Barcelona).Before 3:00 p.m., your accommodation will not be available. If you arrive earlier, please contact us, as you may leave your luggage at the premises free of charge.
Upon arrival at the establishment, and in accordance with current legislation, you must provide us with the booking form, and we will proceed to identify all occupants of the booked rooms.
Subsequently, the reservation holder shall pay the remaining balance of the stay, if any, and the tourist tax of €7.70 per person per night for guests over 16 years old, for a maximum of 7 nights (Law 5/2012 of March 20, D.O.G.C. No. 6094 of 23/03/12). You may pay by credit/debit card or in cash in the establishment’s local currency (€). (Municipal tax subject to variation.)
Check-out: Guests must vacate the room by 11:00 a.m. at the latest, although they may check out earlier if they wish, returning the room keys and paying any pending charges at reception.If you need to leave your suitcases or luggage in storage, this may be done free of charge until 12:00 midnight on the same day, and only for guests of the establishment.
Special Conditions
Children over 8 years old may be accommodated, provided they are accompanied by their parents or a legal guardian and have an official identification document for registration.No cribs or extra beds can be added to this accommodation, except under express request by the client and ACCEPTANCE by the establishment.Pets are not allowed in the establishment.
Client Responsibilities
The client agrees to respect the establishment’s regulations. During rest hours (from 10:00 p.m. to 9:00 a.m.), it is not permitted to use the accommodations for parties or to make noise. Under no circumstances is it allowed to exceed the maximum occupancy of the accommodation.Use of electricity and water must be rational. When the air conditioning is on, please ensure doors and windows remain closed.It is forbidden to hang towels or clothes on balcony railings.Children must always be accompanied by their parents and remain under their supervision.The person holding the reservation is responsible for the proper behavior of all occupants. Otherwise, DORM & DREAM BARCELONA, S.L. reserves the right to expel the occupants from the accommodation without right to future claims or any compensation whatsoever.Neither DORM & DREAM BARCELONA, S.L. nor the property owner shall be held responsible for any direct or indirect damage that may occur as a result of the misuse of the accommodation, including, without limitation: destruction, losses following fires, theft, crime, accidents, or other types of damage.
CANCELLATIONS (RIGHT OF WITHDRAWAL)
DORM & DREAM BARCELONA, S.L. will only accept reservation cancellations in writing, via email to: [email protected]
STANDARD RATE: If the reservation is cancelled more than 7 days before the arrival date, DORM & DREAM BARCELONA, S.L. will refund the client 100% of the first night of their reservation (or the total amount paid by the client).If the reservation is cancelled within 7 days prior to the arrival date, the total amount corresponding to the first night will not be refunded to the client (100% of the first night).
SPECIAL RATES: In the event of cancellation, no refund will be made of any amount paid by the client, whether it corresponds to the first night or the total amount of the reservation, in accordance with the specific conditions of each rate.
CLAIMS / COMPLAINTS
Our goal is for our clients to enjoy a pleasant stay.If, during your stay, any malfunction occurs in the facilities or electrical appliances, you must immediately notify DORM & DREAM BARCELONA, S.L. so that these issues can be resolved as soon as possible.
In the event of force majeure (damage caused by water, fire, etc.), DORM & DREAM BARCELONA, S.L. will replace the reserved accommodation with another of the same characteristics.If there are no accommodations available, DORM & DREAM BARCELONA, S.L. will refund the total amount corresponding to the remaining days not used.

Online Dispute Resolution (ODR)
In accordance with Art. 14.1 of Regulation (EU) 524/2013, the European Commission provides a free-access online platform for the resolution of disputes between the USER and DORM & DREAM BARCELONA, S.L., without the need to resort to courts, through the intervention of a third party, called a Dispute Resolution Body, which acts as an intermediary between both parties.This body is neutral and will communicate with both sides to reach an agreement, and may ultimately propose and/or impose a solution to the conflict.Link to the ODR platform: http://ec.europa.eu/consumers/odr/FORCE MAJEURE
The parties shall not incur any liability for any failure due to a cause of force majeure.The fulfillment of the obligation shall be postponed until the cessation of the case of force majeure.
JURISDICTION (COMPETENCE)
The USER may not assign, transfer, or transmit the contracted rights, responsibilities, or obligations.If any stipulation of these terms and conditions is considered null or unenforceable, the validity, legality, and enforceability of the remaining provisions shall in no way be affected or modified.The USER declares to have read, understood, and accepted these General Conditions in their entirety.
GENERAL PROVISIONS OF THE OFFER
All sales and deliveries made by DORM & DREAM BARCELONA, S.L. shall be understood as being subject to these General Terms and Conditions.No modification, alteration, or agreement contrary to the Commercial Proposal of DORM & DREAM BARCELONA, S.L., or to that stipulated herein, shall have any effect unless expressly agreed in writing and signed by DORM & DREAM BARCELONA, S.L.In such a case, these specific agreements shall prevail.Given the ongoing technical developments and improvements of products, DORM & DREAM BARCELONA, S.L. reserves the right to modify its specifications regarding the information provided in its advertising, as long as it does not affect the value of the services offered.These modifications shall also apply if, for any reason, the supply of the offered products is affected.
PRICE AND VALIDITY PERIOD OF THE OFFER
The prices indicated for each room include Value Added Tax (VAT), except for other applicable taxes (such as the tourist tax), and shall be expressed in EURO currency (€).The prices applicable to each room are those published on the website. The USER acknowledges that the economic valuation of some services may vary in real time. Prices are subject to change daily until the reservation is completed.Any payment made to DORM & DREAM BARCELONA, S.L. entails the issuance of an invoice in the name of the registered USER or the company name indicated at the time of booking.This invoice will be delivered to the USER upon completion of the rental and payment of all contracted services.For any information related to the reservation, the USER may contact the customer service of DORM & DREAM BARCELONA, S.L. by phone at 618769457 or via email at [email protected].

Confirmed reservation with payment of the first night:Minimum service price as stated on the website. The reservation can be made through the payment of the first night.
Confirmed reservation with full payment of the stay:Minimum service price as stated on the website. The reservation can be made through the payment of the total amount of your stay.
Reservation (purchase request) From the Online Reservation section, you can consult the description and characteristics of the accommodation, the included services, optional services (extras), and the specific conditions of each room.The final price will be calculated according to the selected check-in and check-out dates and the number of guests (adults and children).
WARRANTIES AND RETURNS
The warranty of the offered services will comply with the following articles based on Spanish Law 23/2003, of July 10, on Guarantees for the Sale of Goods and Consumer Services:Conformity of services with the contractUnless proven otherwise, it will be understood that the services conform to the contract if they meet all the following requirements, unless any of them are not applicable due to the circumstances:
a) They comply with the description provided by DORM & DREAM BARCELONA, S.L.b) They are suitable for the usual purposes for which services of the same type are intended.c) They are suitable for any special use requested by the client, provided the client informed DORM & DREAM BARCELONA, S.L. at the time of entering into the contract, and the company accepted that the service is suitable for that use.d) They present the usual quality and performance of a service of the same type that the client can reasonably expect, considering its nature and, if applicable, the descriptions of specific service features made by DORM & DREAM BARCELONA, S.L.e) DORM & DREAM BARCELONA, S.L. describes the details, technical characteristics, and photographs of properties provided by their owners, without being legally bound by these public statements.
Any lack of conformity resulting from a service not provided or executed will be considered as a lack of conformity with the contract if the responsibility lies with DORM & DREAM BARCELONA, S.L..Conversely, if the service is not provided due to negligence or malpractice by the USER, it will not be considered a fault of DORM & DREAM BARCELONA, S.L., and the contract will still be deemed fulfilled.No responsibility will arise for conformity issues that the USER knew or could not ignore at the time of entering the contract, or that result from information provided by the USER.
Responsibility of DORM & DREAM BARCELONA, S.L.
DORM & DREAM BARCELONA, S.L. is responsible to the USER for any lack of conformity existing at the time of delivery of the accommodation. The USER has the right to repair, replacement, or contract termination.
Repair and Replacement of Services
If the service does not conform to the contract, the USER may choose to demand either repair or replacement, unless one of these options is impossible or disproportionate.From the moment the USER communicates their chosen option to DORM & DREAM BARCELONA, S.L., both parties must comply. This decision of the USER does not affect situations where the repair or replacement cannot bring the service into conformity with the contract.An option will be considered disproportionate if it imposes costs on DORM & DREAM BARCELONA, S.L. that are unreasonable compared to the alternative option, taking into account:The value the service would have if there were no lack of conformity,
The significance of the non-conformity, andWhether the alternative solution could be implemented without major inconvenience for the USER.Rules for Repair or Replacement of the Service
Repair and replacement will follow these rules:
No cost to the USER: Any necessary expenses to correct the lack of conformity of the contracted services will be free for the USER.Reasonable timeframe: The repair or replacement will be carried out within a reasonable period and without major inconvenience to the USER, considering the nature and purpose of the services.
Persistent non-conformity: If, after repair or replacement, the service still does not conform to the contract, the USER may demand:Another replacement,
A price reduction, or
Contract termination.
If replacement fails: If replacement does not bring the service into conformity, the USER may demand repair, a price reduction, or contract termination.
Time Limits
Unless proven otherwise, the service delivery is considered on the date indicated in the reservation.The USER must inform DORM & DREAM BARCELONA, S.L. of any lack of conformity as soon as it is noticed, or at the latest, at the end of the stay.Unless proven otherwise, it will be understood that the USER has communicated the issue within the established timeframe.
APPLICABLE LAW AND JURISDICTION
These terms shall be governed and interpreted in accordance with Spanish law in all matters not expressly stipulated.
DORM & DREAM BARCELONA, S.L. and the USER agree to submit any dispute arising from the provision of products or services under these Terms to the courts and tribunals closest to BARCELONA.
If the USER is resident outside Spain, both DORM & DREAM BARCELONA, S.L. and the USER expressly waive any other jurisdiction, submitting to the Spanish jurisdiction described above.
